Supreme Court confirms Mbah as Enugu governor
In a significant development on Friday, the Supreme Court delivered a verdict affirming the election victory of Governor Peter Mbah in Enugu State.
Justice Mohammed Garba, in the lead judgment, dismissed the claim that Mbah lacked a National Youth Service Corps (NYSC) certificate, labeling it as a mere allegation.
Addressing all raised concerns in the appeal against the appellant, Chijioke Edeoga of the Labour Party, who had challenged the decision of the Court of Appeal dismissing his case against the governor’s election, the Supreme Court upheld the earlier resolution. Edeoga had brought INEC and Mbah before the court.
The unanimous decision from the Lagos Division of the Appeal Court, headed by Justice Tani Hassan, refuted all three issues presented by the appellant.
The panel emphasized that Edeoga failed to substantiate the claim that the respondent was ineligible to participate in the gubernatorial election.
Regarding the accusation of over-voting, Justice Hassan highlighted that the voters’ register was not presented before the lower tribunal. She stressed that the failure to submit the voters’ register rendered the appeal inadmissible.
The Supreme Court’s decision solidifies Governor Mbah’s legitimacy in the face of legal challenges, providing a decisive conclusion to the case.
